Dear Clearinghouse Vultures:

I have done everything I can do short of litigation to extract my relative, Deleta Four Privacy, from your clutches.  We should have heard nothing from you since February of this year, but you continue to fill our recycling bin.

My wife is her attorney in fact and I am her attorney at law.  I have previously instructed you, both verbally and in writing, not to contact her for any purpose.

I have told you that if you persist in mailing her your junk we are not returning it and we are not paying for it.  I am out of ways to say, “Cease and desist.” I don’t expect you to give back everything you stole from her while she was incompetent but I do expect you to stop it.

Now we get another bill.  This billing is a direct violation of the Fair Debt Collection Practices Act, 15 USC §1692c (a)(2).  

Leaving aside the discourtesy, it is unlawful to further bill anybody you know to be represented by counsel.  It exposes you to any actual damages, up to $1,000 in nominal damages, as well as any court costs and attorney fees.  

If you have anything to say, say it to me.  If you do not comply with federal law by honoring this letter, I will be forced to take action because this is a family matter.  Does it really have to come to that?

If you seriously think you have any rights against an elderly woman who was diagnosed with dementia long before you were told to cease and desist, then kindly place your threats where the sun don’t shine, file your lawsuit, and wait for my counterclaims.
